Terms of service

These terms are an agreement between you and Giving Boldly LLC, a Missouri limited liability company, for purchases from this store. By ordering, you agree to these terms and to our Privacy, Returns, and Shipping Policies, which are part of this agreement. Contact: Giving Boldly LLC, 334 E Kearney St, Suite 354, Springfield, MO 65803-3018, giving@givingboldly.com

  1. Shoppers. You must be 18 or older, or have a parent or guardian's permission, to purchase. You are responsible for the accuracy of the information you provide, including personalization details.

  2. Orders. Your order is an offer to buy; a contract forms when we email your order confirmation. We may decline or cancel an order, for example, suspected fraud or an item we cannot fulfill. If we cancel an order you paid for and we have not shipped it, you receive your payment back.

  3. Prices and errors. Prices are in U.S. dollars. Sales tax is calculated and collected at checkout where the law requires us to collect it. If a price or product description contains an obvious error, we may correct it, and if you already ordered we will contact you and offer cancellation with your payment back or the corrected terms, your choice.

  4. Payment. Payment is processed through Shopify and its payment providers. We do not store your full card number.

  5. Personalization. Personalized products are made to the text and options you submit. You confirm you have the right to use any names, images, or text you provide. The order is made as shown in the preview and as typed. Please double-check spelling, names, dates, and options before you order, because a personalization error that came from the information you gave us is not covered.

Giving Boldly LLC is a for-profit business. It is not a charity, and it is not owned by a charity.

Buying something from this store does not benefit any charity. No part of the price you pay is earmarked for charity, donated because of your purchase, or tax-deductible as a donation. We do not ask customers for donations, and we do not offer a round-up or donation at checkout.

Separately from the store's sales, the owner sometimes gives some of his own money to charities he chooses. That is the owner's personal decision, made after a quarter has ended. It is not tied to any customer's purchase, and it is not promised for any future quarter. Future donations, if any, will be at the owner's sole discretion, in whatever amount he chooses, or in no amount at all.

Reports of past donations, if published, appear on our separate mission page. A report records a completed gift only. Listing a charity there does not mean that charity endorses this store or its products. "Profit" on that page means revenue minus cost of goods, platform and payment fees, shipping, advertising, and other operating expenses, before the owner's draw and before tax. Those figures are not audited financial statements.

  1. Your content and reviews. Content you send us to make your product, personalization text and images, stays yours; you give us a license to use it only as needed to make and deliver your order, and to keep it with your order record for remakes and service. Nothing in these terms limits your right to post honest reviews of our products or business, asks you to waive that right, or assigns us your reviews. That right is protected by the Consumer Review Fairness Act and we honor it.

  2. Our content. The store's text, logos, and designs belong to Giving Boldly LLC or its licensors and may not be copied for commercial use without permission.

  3. Acceptable use. Do not use the store for unlawful purposes, to submit fraudulent orders or false information, or to interfere with the store's operation.

  4. Product descriptions. We work to describe products accurately, including materials, sizes, and where items are made and shipped from. Colors may vary slightly between screens and the physical item. Descriptions do not override your rights under our Returns Policy or applicable law for defective or incorrect goods.

  5. Returns and refunds. There are no refunds anywhere, across the board, period. There are no returns for change of mind, and there are no returns on a product that is exactly what you ordered. Returns are for defects and damage only, and for an item that is wrong compared to your order. Contact us within 10 days after delivery, with pictures and video showing the damage or the problem. If you received the wrong item, please include a video showing the product and the packaging it arrived in. You may be requested to make additional pictures or video to show the damage. If a damaged item needs to be returned, we will advise you on the return of that item, and each case will be addressed individually. Please do not send the item back until we advise you. For a defective, damaged, or wrong item, we will remake the item correctly, shipped free. We do not accept returns on personalized items.

  6. Shipping. Your gift is made for you after you order; it is not pulled from a shelf. Production time is 3 to 5 business days after your order and personalization details are complete. Transit time is 2 to 5 business days within the continental United States for standard shipping. Total typical delivery is about 1 to 2 weeks from order. Shipping charge is a flat $5.99 per order, shown at checkout. See the Shipping Policy for delays, address problems, and your rights.

  7. Warranties and liability. The store and products are provided subject to the commitments in our Returns and Shipping Policies and to any warranties that cannot be waived under applicable law; apart from those, we disclaim implied warranties to the extent the law allows. To the extent permitted by law, our total liability for any claim arising from an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential damages. Nothing in these terms limits liability that cannot be limited under Missouri or federal law.

  8. Governing law. These terms are governed by Missouri law. Disputes will be brought in the state or federal courts located in Greene County, Missouri.

  9. Changes. We may update these terms; the version posted at the time of your order governs that order.

  10. Severability. If any part of these terms is unenforceable, the rest remains in effect.
